Planning changes allowing pubs and restaurants to provide takeaway
As I predicted in an earlier post we now have an amendment to the General Permitted Development (England) Order 2016.
The effect of the amendment is to allow premise with an existing A3 use (restaurant/café) to operate with a takeaway use – this includes the provision of hot or cold food that has been prepared for consumers for collection or delivery to be consumed, reheated or cooked by consumers off the premises.
The permitted use will remain in force for a year up to 23rd March 2021 and at the end of that period the premises use will revert to the use prior to the amendment. It does not affect the existing use as a restaurant/café or public house.
Please note that if you use the premises in this way there is no requirement for a planning application but you should notify the local planning authority that of your intention.
